Welcome to Lives! These Terms of Service (hereinafter referred to as the "Terms") govern the relationship between users and the independent developer Lukas Pierce (hereinafter referred to as the "Administration," "we," "us," or "our") when using the Lives mobile application (hereinafter referred to as the "Service").
1. Service Description
Lives is a platform for posting and searching real estate listings, as well as for interaction between users, including realtors, property owners, tenants, and buyers.
2. Registration and Account
2.1. To access the Service's functionality, users must create an account.
2.2. Users must provide accurate information during registration and keep it up to date.
2.3. Age Restriction: Registration is only available to individuals over 18 years old.
2.4. Users are responsible for the security of their account credentials and must not share them with third parties.
2.5. In case of lost account access (e.g., due to a forgotten password or lost device), users can request recovery through the provided contact details. We may require additional identity verification to protect the account.
3. User Rights and Responsibilities
3.1. Users must comply with applicable laws and refrain from posting prohibited content (fraudulent listings, misinformation, etc.).
3.2. The Service may not be used for spam, fraud, or any illegal activities.
3.3. The Administration reserves the right to delete or block accounts for violating the Terms without prior notice.
4. Administration Rights and Responsibilities
4.1. We provide access to the Service "as is" without guarantees of uninterrupted operation.
4.2. The Administration is not responsible for users' actions or the accuracy of posted information.
4.3. We have the right to modify the Service, its functionality, and access conditions without prior notice.
5. Paid Services
5.1. The Service may offer paid features (e.g., ad highlighting, promotion, etc.).
5.2. Payments are made according to the rates applicable at the time of service.
5.3. Refunds are only available in cases provided by law or our internal policies.
Payments via Apple and Google
- If payment is made through Apple App Store or Google Play, users must follow the terms and conditions of these platforms.
- Refunds and disputes related to payments made through Apple or Google are governed by their refund policies.
- We cannot interfere with the refund process if the payment was processed via Apple or Google.
- In case of payment issues, users should contact the support team of the respective platform.
6. Privacy
6.1. Our Privacy Policy governs the processing of users' personal data and is an integral part of these Terms. It is available at: https://app-lives.com/privacy-policy.
6.2. By registering for the Service, users agree to the terms of data processing.
7. Disclaimer
7.1. Lives provides a platform for posting listings but does not participate in transactions between users and is not responsible for their fulfillment.
7.2. We do not guarantee the accuracy, completeness, or relevance of information posted by users.
8. Dispute Resolution
8.1. In the event of disputes, users should attempt to resolve them through negotiations with the Administration.
8.2. If a dispute cannot be resolved amicably, it will be settled in court in accordance with the laws of the country where the user is located unless otherwise required by law or applicable regulations.
9. Additional Conditions for Global Use
9.1. Liability Limitation in Accordance with U.S. Law
- In jurisdictions where liability limitations are invalid, they apply to the maximum extent permitted by local law in favor of the Administration.
9.2. Arbitration and Class Action Waiver
- Any disputes between the user and the Administration shall be resolved through individual arbitration, except where explicitly prohibited by local law.
- Users agree that all claims must be handled individually and not combined with claims of other users, even if local laws permit class actions.
- If a jurisdiction does not allow a complete waiver of class actions, this clause shall be interpreted to minimize the risk of class actions against the Administration as much as local law permits.
9.3. Content Removal Policy
- We comply with the U.S. Digital Millennium Copyright Act (DMCA) and process copyright infringement complaints accordingly.
9.4. Restricted Regions and Sanctions
- Use of the Service is prohibited in countries subject to U.S. sanctions and other international restrictions.
9.5. Governing Law
- All terms are governed by the laws of the country where the user is located. However, additional requirements may apply in certain jurisdictions.
10. Changes to the Terms
10.1. We reserve the right to modify these Terms at any time.
10.2. Updated versions take effect immediately upon publication in the Service.
